Vertical Weather Terms of Use
Version 1, effective 25 September 2026
These terms govern your use of the Vertical Weather API, its documentation, dashboard, client libraries and MCP server (together, the “Service”). The Service is provided by Stephen Filios, Germany (“we”, “us”); the postal address is in the Impressum. Contact: support@verticalweather.com.
By creating an account, creating an API key or calling the API, you agree to these terms. If you use the Service for an organisation, you confirm that you may accept these terms for it.
1. Not for safety-critical decisions
Section titled “1. Not for safety-critical decisions”The Service provides model-derived weather estimates. It is not a certified aviation, meteorological or flight-safety service. Do not use it as the sole or primary basis for any decision where an error could injure people or damage property, including launching rockets, flying aircraft, drones or balloons, or planning flights. Always use official weather sources and follow the rules that apply to your activity.
Forecasts are uncertain. Model output can be wrong, late, incomplete or unavailable, and it describes a model grid point and model time that may differ from the location and time you requested. The response states what was used.
2. The Service during the free beta
Section titled “2. The Service during the free beta”- The Service is currently a free beta. We may change, limit, suspend or end it, or any feature of it, at any time. We will give reasonable notice of material changes where we can, by email or on verticalweather.com.
- There is no service-level agreement. Availability depends on us and on upstream data providers such as NOAA.
- Usage limits (for example requests per second, per minute and per day) are published in the API’s capabilities endpoint and documentation. We may adjust them to protect the Service.
- Paid plans are not offered yet. If we introduce them, separate terms will apply and you will have to accept them before paying anything.
3. Accounts and API keys
Section titled “3. Accounts and API keys”- You need an account to get API keys. Give accurate information and keep your sign-in secure.
- API keys are secrets. Keep them on your server; do not embed them in apps, websites or public code. You are responsible for all use of your keys. Revoke a key in the dashboard if it may have been exposed.
- One person or organisation should not create multiple accounts to get around usage limits.
4. Acceptable use
Section titled “4. Acceptable use”You must not:
- exceed, work around or test the limits of the Service (including with multiple accounts or keys), or load- or security-test it without our written permission;
- interfere with the Service, other users or our upstream data providers;
- use the Service for anything unlawful;
- resell or sublicense access to the API itself, or use it to build a substantially similar bulk weather-data service;
- misrepresent the source of the data or suggest that NOAA or any other data provider endorses you or your product.
5. Using the data you receive
Section titled “5. Using the data you receive”- You may use, store, display and include the responses in your own applications and services, including commercial ones, subject to section 4.
- Source data is from NOAA’s Global Forecast System (GFS), a U.S. government work. Keep the provenance information with the data where practical, and do not remove or alter attribution in a way that would mislead your users about where the data came from.
- If we add other data sources, their licence terms may require specific attribution. We will state those requirements in the response and documentation, and you agree to follow them.
6. Our intellectual property
Section titled “6. Our intellectual property”We keep all rights in the Service, its software, documentation and branding, except for rights in third-party data and open-source components. Client libraries are licensed under the licence stated in their packages.
7. Suspension and termination
Section titled “7. Suspension and termination”- You can stop using the Service and delete your account at any time.
- We may suspend or revoke access, immediately if necessary, if you breach these terms, if your use endangers the Service or others, or if required by law. Otherwise we may end your access with reasonable notice.
8. No warranty
Section titled “8. No warranty”To the extent permitted by law, the Service is provided free of charge and “as is”, without any warranty that it will be accurate, complete, available, or fit for a particular purpose. Statutory rights that cannot be excluded remain unaffected.
9. Liability
Section titled “9. Liability”Because the beta is provided free of charge:
- We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have given a guarantee.
- Otherwise we are not liable for damage caused by simple negligence.
10. Changes to these terms
Section titled “10. Changes to these terms”We may update these terms. We will publish the new version with a new version number and date, and notify account holders of material changes at least 30 days before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, stop using the Service and delete your account.
11. Governing law
Section titled “11. Governing law”German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory laws of the country where you live. If you are a merchant (Kaufmann), a public-law entity or have no general place of jurisdiction in Germany, the courts at our place of business have exclusive jurisdiction.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision is invalid, the rest of these terms remains in effect.
